Strasbourg Court will consider the complaint for the arrest of Khodorkovsky in the first case.

The court found plaintiff's contentions about the illegality of his criminal prosecution suitable for consideration. Hearing date has not yet been appointed. The Russian authorities allotted time before July 10, 2009, to appeal against the decision on the complaint admissible.
In 2007, the ECHR partially granted a similar complaint of Platon Lebedev, finding a violation of the European Convention on Human Rights, in three out of ten contained episodes, and decided to pay the plaintiff 10 thousand euros in compensation for moral damages and reimbursement of litigation costs.
In 2005, Khodorkovsky and Lebedev were arrested in 2003 were sentenced to eight years in prison. They were found guilty of financial mismanagement and tax evasion.
Since March 2009 in Moscow Hamovnicheskom court held a hearing on the second case against the two businessmen, who are accused of stealing crude oil and the shares of subsidiary companies Yukos in an amount of almost 900 billion rubles.
Khodorkovsky and Lebedev are not guilty. They consider the case brought against them politically motivated.
